This Privacy Policy explains how Dualverse, Inc. (“Dualverse,” “we,” “us,” or “our”) handles information in connection with the mobile application Santa Tracker – Track Santa and related features, content, services, in-app purchases, virtual credits, and updates (the “App”).

The App is a family entertainment app and Santa tracking simulator designed to create a magical Christmas experience for children and families. Children should use the App only with the guidance and permission of a parent or legal guardian.

1. Summary of Our Privacy Practices

We designed the App to use only the information needed to provide its holiday entertainment features.

In general:

  • We do not require users to create an account.
  • We do not ask users to log in.
  • We do not store the exact home address of users.
  • The home marker is used for the Santa tracking experience and is primarily stored and used on the device.
  • Parent-controlled personalization settings are off by default.
  • Certain information may be sent to OpenAI only when needed to provide AI Santa chat or when a parent or guardian enables specific personalization options.
  • The free version of the App may show ads through Google AdMob.
  • In-app purchases are processed by Apple App Store or Google Play.
  • We do not use Firebase Analytics, Firebase Crashlytics, Google Analytics, or similar third-party analytics/crash reporting tools in the App, based on the current version described in this policy.

2. Information We Do Not Require

The App does not require users to provide:

  • a user account;
  • login credentials;
  • a real full legal name;
  • an email address for normal app use;
  • a phone number;
  • an exact street address;
  • government identification;
  • payment card information directly to Dualverse.

Payments are handled by the applicable app store or platform provider, such as Apple App Store or Google Play.

3. Information You or a Parent May Choose to Provide

The App may allow a parent, guardian, or user to enter or select information for entertainment and personalization purposes, such as:

  • child’s name;
  • age;
  • gender;
  • general location or where the child lives;
  • what the child wants for Christmas;
  • profile image, avatar, or selected image;
  • chat messages sent to Santa;
  • other holiday preferences or settings.

By default, personalization options may be turned off. Paid users may be able to enable specific personalization options in the Parents Only section.

Please do not enter highly sensitive or unnecessary information, including exact street addresses, school names, private security details, medical information, financial information, government identification numbers, or information that you do not have permission to provide.

4. Location Information and Home Marker

The App may request device location permission to help place an approximate location on the map and allow users to set a home marker. This location feature is used to create the App’s simulated Santa tracking experience.

When the user first uses the App, the App may ask for location permission so it can place the user’s approximate location on the map. The user can then manually move the home marker, leave it as initially detected, or reset it back to the current device location.

Location and home marker information is primarily used on-device. Dualverse does not store the user’s exact home address. Users can control location permission through device settings.

If a parent or guardian enables location-related personalization in the Parents Only section, selected general location information may be included in prompts sent to our AI service provider to help Santa provide more personalized replies.

You should not enter or enable highly sensitive, unnecessary, or exact personal information, including exact street addresses, school addresses, private security details, or other sensitive information.

5. AI Santa Chat and OpenAI

The App may include an AI-powered Santa chat feature using technology provided by OpenAI.

When a user sends a message to Santa, the message may be sent to OpenAI so that an AI-generated Santa response can be created. If a parent or guardian enables paid personalization settings, selected enabled details may also be included in the prompt sent to OpenAI, such as:

  • child’s name;
  • age;
  • gender;
  • general location or where the child lives;
  • what the child wants for Christmas;
  • other enabled personalization details.

These details are used to help Santa provide more magical and personalized replies.

AI Santa chat is for entertainment only. AI-generated responses may be inaccurate, unexpected, incomplete, delayed, or unavailable. Parents and guardians should supervise children’s use of AI chat.

OpenAI may process API inputs and outputs according to OpenAI’s own policies and data processing practices. Dualverse does not control OpenAI’s independent systems, security practices, or legal obligations.

6. Profile Images and Photos

The App may allow users or parents to select or use a profile image, avatar, or photo for personalization or display inside the App.

Unless a feature clearly indicates otherwise, profile images are intended to be used locally within the App experience. We do not use profile images for advertising or selling user information.

Please do not upload or select images that are inappropriate, unlawful, or that you do not have permission to use.

7. Advertising

The free version of the App may display ads. We currently use Google AdMob as our advertising provider.

Google AdMob and related Google services may collect or receive information from your device to provide, limit, measure, and improve ads. This may include information such as device identifiers, advertising identifiers, IP address, app interactions, approximate location, device information, and ad interaction data, depending on your device settings, consent choices, region, and applicable law.

Ads may be personalized or non-personalized depending on your privacy settings, consent choices, device settings, region, and applicable law.

You may be able to limit ad tracking or reset your advertising identifier through your device settings. In certain regions, you may also be shown privacy or consent choices related to advertising.

For European Economic Area, UK, and Switzerland Users: Until our in-app advertising consent preference tool is available, you may manage personalized advertising choices at the device or platform level. You may be able to limit personalized ads, restrict tracking, or reset your device’s advertising identifier through your device settings, such as iOS privacy and tracking settings or Android Google ads settings. These device-level controls may help limit personalized advertising, but they may not replace any consent choices that are required inside the App. We are working to add an in-app consent preference option.

Purchasing certain in-app items may remove third-party ads, depending on the purchase description shown at the time of purchase. Some non-ad notices, app messages, cross-promotions, purchase messages, or service-related announcements may still appear.

8. In-App Purchases and Payment Information

The App may offer in-app purchases, including packages, premium content, personalization features, and virtual credit packs.

Purchases are processed by the applicable platform provider, such as Apple App Store or Google Play. Dualverse does not directly collect or store your full payment card number, bank account information, or app store password.

We may receive limited purchase-related information from the platform, such as purchase confirmation, product identifier, transaction status, receipt information, refund status, or entitlement status, as needed to provide purchased content, restore purchases, support users, prevent fraud, and comply with platform rules.

Refund requests are generally handled by Apple App Store or Google Play according to their policies. If you have a purchase issue, missing unlock, restore problem, or credit issue, you may contact us at contact@dualverse.com.

9. Virtual Credits

The App may provide users with 3 free credits each day. Free daily credits are separate from paid credits. Free credits refresh at or around midnight and do not accumulate beyond the daily maximum. The maximum amount of free daily credits a user can have at any time is 3. If unused, free credits may reset or be replaced by the next day’s free credit amount.

We may change, reduce, suspend, or discontinue free daily credits at any time, including the number of free credits offered, the refresh timing, eligibility rules, or availability of the free credit program.

The App may also offer paid credit packs, such as 50 credits, 500 credits, and 5000 credits. Paid credits are consumable digital items that may be used for certain features, including AI Santa chat or other paid interactions.

We may process credit balances, credit usage, and purchase status as needed to provide and support credit-based features. If an AI chat response is not generated or a service failure occurs before completion, we will make reasonable efforts to ensure that credits are not unfairly deducted.

10. Children’s Privacy

The App is designed for family entertainment and should be used by children only with parent or guardian permission and supervision.

We do not require children to create accounts, provide email addresses, or directly submit contact information to use the App.

Parents and guardians are responsible for deciding whether to allow a child to use the App, whether to enable personalization features, and what information may be entered. Parent-controlled personalization settings are off by default and may be managed in the Parents Only section.

The App may use a simple math quiz, parental gate, or similar prompt before allowing access to the Parents Only section. This parental gate is used only to help separate grown-up settings from child-facing entertainment areas. We do not use the math quiz to identify users, create accounts, or collect personal information.

11. How We Use Information

We may use information as reasonably necessary to:

  • provide and operate the App;
  • display Santa tracking, home marker, countdown, and map-based experiences;
  • provide AI Santa chat responses;
  • apply parent-enabled personalization settings;
  • provide purchased packages, credits, and entitlements;
  • restore purchases and support purchase issues;
  • show, limit, measure, and support ads through Google AdMob;
  • maintain app security and prevent abuse;
  • respond to support requests;
  • comply with legal obligations and platform rules;
  • improve app functionality and user experience.

We do not use parent-entered personalization details to sell user information.

12. How Information May Be Shared

We may share or transmit information in the following limited situations:

Service Providers

We may share information with service providers as needed to operate the App, including OpenAI for AI Santa chat, Google AdMob for ads, Apple App Store and Google Play for purchases, and map or operating system services for app functionality.

Legal and Safety Reasons

We may disclose information if we believe it is necessary to comply with law, respond to lawful requests, enforce our terms, protect users, protect children, prevent fraud or abuse, or protect the rights, property, or safety of Dualverse or others.

Business Transfers

If Dualverse is involved in a merger, acquisition, financing, restructuring, sale of assets, or similar business transaction, information related to the App may be transferred as part of that transaction, subject to applicable law.

With Your Direction or Consent

We may share information when you or a parent/guardian direct us to do so, enable a feature, or provide consent.

13. Third-Party Services

The App may interact with or depend on third-party services, including:

  • Apple App Store;
  • Google Play;
  • Apple Maps;
  • Google Maps;
  • Google AdMob;
  • OpenAI;
  • device operating system services;
  • payment and platform services.

These third-party services may process information according to their own privacy policies and terms. We encourage parents and guardians to review the privacy practices of relevant third-party services.

Dualverse is not responsible for the privacy practices, content, policies, or security of third-party services that we do not control.

14. Data Retention

We retain information only for as long as reasonably necessary for the purposes described in this Privacy Policy, unless a longer retention period is required or permitted by law, platform rules, dispute resolution, fraud prevention, security, or business records.

Information stored locally on your device may remain on your device until you delete it, reset the App, clear app data, or uninstall the App.

Certain information processed by third-party services, such as OpenAI, Google AdMob, Apple, or Google Play, may be retained according to those third parties’ own policies and legal obligations.

15. Data Security

We use reasonable administrative, technical, and organizational measures designed to protect information handled by the App.

However, no app, network, device, server, internet transmission, AI service, or storage system can be guaranteed to be 100% secure. Parents and guardians should avoid entering sensitive information into the App.

16. Your Choices and Controls

Depending on your device, platform, and region, you may have choices such as:

  • enabling or disabling device location permission;
  • resetting or limiting your advertising identifier;
  • managing personalized advertising settings;
  • managing app tracking permissions;
  • managing notification permissions;
  • editing or disabling personalization settings in the App;
  • deleting local app data;
  • uninstalling the App;
  • requesting purchase support or restore help;
  • contacting us with privacy questions.

Some features may not work correctly if certain permissions are disabled.

17. International Users

Dualverse is based in South Korea. By using the App, you understand that information may be processed in South Korea, the United States, or other countries where Dualverse, platform providers, or service providers operate.

Privacy laws in these countries may differ from those in your location.

18. U.S. State Privacy Rights

Depending on where you live, you may have rights under applicable privacy laws, such as the right to request access, correction, deletion, or information about certain personal information.

Because the App does not require accounts, we may need enough information to verify and process your request. In some cases, we may not be able to identify or access information stored only on your device.

We do not knowingly sell personal information in the traditional sense. However, advertising services may process device identifiers or ad-related information in ways that may be considered “sharing” or “targeted advertising” under some privacy laws. You may be able to control personalized ads or tracking through your device settings and any consent choices shown in the App.

19. European, UK, and Similar Privacy Rights

If you are located in the European Economic Area, United Kingdom, Switzerland, or another region with similar privacy rights, you may have rights to request access, correction, deletion, restriction, objection, portability, or withdrawal of consent, subject to applicable law.

The legal bases for processing may include:

  • performance of a contract, such as providing the App and purchased features;
  • consent, such as certain permissions or personalized advertising choices;
  • legitimate interests, such as security, support, fraud prevention, and app operation;
  • compliance with legal obligations.

20. California Privacy Notice

If you are a California resident, this section provides additional information.

Depending on how you use the App, categories of information that may be processed include:

  • identifiers, such as device identifiers or advertising identifiers;
  • approximate location information;
  • commercial information, such as purchase status or entitlement information;
  • internet or electronic network activity information, such as ad interaction or app usage data processed by advertising services;
  • user-provided content, such as chat messages or personalization details if enabled;
  • visual information, such as profile image or avatar if selected by the user.

Purposes may include providing the App, supporting purchases, providing AI chat, showing or measuring ads, preventing abuse, and responding to support requests.

We do not knowingly sell children’s personal information. Advertising services may process certain information for personalized advertising or cross-context behavioral advertising depending on settings, consent, and applicable law.

21. Do Not Track

Some browsers or devices may send “Do Not Track” signals. The App does not currently respond to browser-based Do Not Track signals. You can manage many privacy choices through your device settings, app permissions, advertising settings, and any consent choices shown in the App.

22. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we make changes, we may update the “Last Updated” date, post the revised policy in the App, or provide notice as required by law.

Your continued use of the App after the updated Privacy Policy becomes effective means you acknowledge the updated policy.
